These Terms of Service ("Terms") govern your access to and use of Maui, our AI colleague for businesses, and the website at sales.mfautomations.ai (together, the "Service"), provided by MF Automations ("MF Automations," "we," "us," or "our"). By using the Service or contacting Maui, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. The Service
Maui is an AI-powered communications and scheduling assistant that can answer and place calls, respond to texts and emails, follow up with leads, book appointments, and maintain records of interactions. Features may change over time.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service on behalf of a business, you represent that you are authorized to bind that business to these Terms.
3. Demo bookings & communications
When you call, text, message, or email Maui, or request a demo, you consent to be contacted by Maui and MF Automations at the phone number and email address you provide, in connection with your request and the Service.
4. Messaging terms (SMS, iMessage & WhatsApp)
- By texting, iMessaging, or WhatsApp-messaging the number listed on our site, or by providing your number and opting in, you consent to receive messages from Maui and MF Automations, which may be sent using automated technology.
- Message frequency varies. Message and data rates may apply.
- You can opt out at any time by replying STOP; reply HELP for help.
- Consent to receive messages is not a condition of any purchase.
- WhatsApp messaging is also subject to WhatsApp's own terms and policies.
5. Acceptable use
You agree not to: (a) use the Service unlawfully or for any fraudulent, harassing, or abusive purpose; (b) interfere with or disrupt the Service; (c) attempt to gain unauthorized access to the Service or related systems; (d) reverse engineer or misuse the Service; or (e) use the Service to send spam or unlawful communications.
6. Intellectual property
The Service, including its software, content, branding, and design, is owned by MF Automations and its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with these Terms. All rights not expressly granted are reserved.
7. Third-party services
The Service may rely on or link to third-party services (such as telephony, messaging, calendar, and AI providers). We are not responsible for third-party services, and your use of them may be subject to their own terms.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or fully secure.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MF AUTOMATIONS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. Our total liability for any claim relating to the Service will not exceed the amount you paid us, if any, for the Service in the twelve months before the claim.
10. Indemnification
You agree to indemnify and hold harmless MF Automations from any claims, damages, liabilities, and expenses arising out of your use of the Service or your violation of these Terms.
11. Governing law
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. The exclusive venue for any dispute will be the state or federal courts located in Miami-Dade County, Florida.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
